Welcome to Rare Plus Apparel! These Terms of Use (“Terms,” “Agreement”) govern your use of our website, services, and online store (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
1. General Information
Rare Plus Apparel (“we,” “our,” “us”) creates unique movie- and pop-culture-inspired apparel and accessories. All visitors (“you,” “your,” “customer”) who access or use our Site are subject to these Terms.
2. Eligibility
You must be at least 13 years old (or the age of majority in your jurisdiction) to use this Site. If you are under 18, you may use the Site only with involvement of a parent or guardian.
3. Products & Availability
We strive to display accurate product information, but colors may vary depending on your device’s display and availability may change without notice. We reserve the right to modify, suspend, or discontinue products at any time.
4. Orders & Payment
When you place an order, you agree to provide accurate and complete information. Prices are listed in USD and are subject to change without notice. Taxes and shipping costs are calculated at checkout. Payment must be received before your order is processed. We reserve the right to refuse or cancel any order for any reason (e.g., fraud suspicion, incorrect pricing).
5. Shipping & Delivery
Estimated shipping times are provided at checkout but are not guaranteed. We are not responsible for delays outside our control (e.g., postal disruptions, customs delays). Risk of loss passes to you upon delivery by the carrier. Orders are processed within 1–3 business days and typically arrive within 3–7 business days after dispatch.
6. Returns & Exchanges
Please refer to our Return Policy for full details. Since items are custom printed through Printify and other print-on-demand providers, all sales are final except for damaged or defective items. Items must be reported within 30 days of receipt. Refunds are issued once we receive and inspect the item.
7. Promotions & Discounts
Promo codes (e.g., “10% off first order”) are valid for one-time use per customer unless stated otherwise. They cannot be combined with other discounts unless explicitly noted. We may modify or end promotions at any time.
8. Intellectual Property
All designs, logos, text, images, and content on the Site are owned by Rare Plus Apparel or its licensors. Most designs are original creations and not affiliated with third-party brands. Some items available on our Redbubble or TeePublic stores are officially licensed through fan art programs. You may not copy, reproduce, distribute, or use our intellectual property without written permission.
9. User Conduct
You agree not to use the Site for unlawful purposes, attempt to interfere with security or proper functioning of the Site, or post false, harmful, or defamatory content.
10. Third-Party Services
Our Site may link to third-party websites (e.g., Instagram, payment providers, Redbubble, TeePublic). We are not responsible for their content, privacy policies, or practices. We use Printify and other print-on-demand providers to fulfill orders, and these third parties have their own terms and policies.
11. Limitation of Liability
To the fullest extent permitted by law, Rare Plus Apparel is not liable for indirect, incidental, or consequential damages resulting from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product or service at issue.
12. Disclaimer of Warranties
The Site and all products are provided “as is” without warranties of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify and hold harmless Rare Plus Apparel, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

These Terms are governed by the laws of Nova Scotia, Canada. Any disputes shall be resolved in the courts of Nova Scotia, Canada.
